The present role is part of the Sime Darby Motors Australia business. Sime Darby Motors Australia represents iconic brands including BMW, MINI, Volvo, Volkswagen, Porsche, Jaguar, Land Rover and Rolls-Royce.
Overview:

Due to ongoing growth and development and our vision of being the leading Motors and Industrial player in Asia Pacific, we are seeking a motivated, detail-oriented, and collaborative Junior Legal Counsel who is eager to learn and grow to join the Sime Darby Motors Legal function in Australia.

Reporting to a highly experienced and highly regarded Senior Legal Counsel, you will play a key role in supporting our businesses in the areas set out below (as well as additional areas as directed by the Senior Legal Counsel across the breadth of in-house legal operations) giving you the opportunity to grow and develop into a highly effective, commercially oriented and trusted in-house legal business partner:

  • Review, negotiate, draft and advise on commercial agreements generally to ensure the business' legal rights and interests are protected and/or enforced and to minimize legal risks and breaches of law/contract.
  • Review, negotiate, draft and advise on commercial property lease agreements for various types of properties leased by the business, including automotive retail showrooms, service and repair facilities, vehicle storage facilities and warehouse facilities. Some leases will include provision for landlord and/or tenant works, as well as early access arrangements.
  • Provide legal advice and guidance to clients on all aspects of commercial leasing transactions, including lease terms, rights and obligations of landlords and tenants, lease renewals, assignments, subleases, and lease amendments.
  • Review, negotiate, draft and advise on commercial construction agreements, including upgrade works on existing premises and construction of new premises.
  • Provide legal support on the resolution of disputes and conflicts related to commercial agreements and commercial leases, including contract/lease performance obligations, breaches, default and potential termination.
  • Provide legal support on dispute resolution and litigation matters generally, including but not limited to product liability claims, Australian Consumer Law claims, contractual disputes and general commercial disputes.
  • Stay up to date on relevant laws, regulations and industry trends affecting the business with a specific focus on commercial property, commercial leasing and commercial construction practice.
  • Work on any other matter(s) as may be assigned by the Senior Legal Counsel and/or Head of Legal, Sime Darby Motors.

About You:

  • Tertiary qualifications in Law, with an admission as a solicitor in NSW and a current NSW practicing certificate.
  • Prior in-house experience or law firm experience specialising in commercial property leases and commercial construction matters is essential.
  • Prior in-house or law firm experience advising on commercial agreements generally is desirable.
  • Prior in-house or law firm experience in dispute resolution/litigation is desirable.
  • Well versed in applicable Australian common law and statutory requirements with a specific focus on commercial leases and commercial construction matters (essential) and commercial agreements (desirable).
  • Minimum 3 years post qualification working experience as a legal counsel (in-house) or lawyer (law firm).
  • Excellent skills in MS Office Packages.
